Record Expungement

One mistake does not have to haunt you for a lifetime. Obtaining an expungement, or clearing your criminal records, removes all record of a past arrest and enables you to move on with your life and put those past transgressions behind you.

At the Law Offices of Thomas Glasgow, Ltd. in Schaumburg, Illinois, our lawyers successfully handle anywhere from ten to twelve expungements per month for those clients who have past misdemeanor and some felony arrests on their record. The majority of misdemeanor arrests, with the exception of DUI and domestic violence arrests, are capable of being expunged if you have completed supervision and do not have a conviction. Certain felony drug arrests are also expungeable, including Treatment Alternative to Street Crimes (TASC), as well as 1410 and 1710 probations issued for drug crimes.

Please note that even though a conviction on any misdemeanor or felony charge will bar you from obtaining an expungement, you can always apply for clemency if you have a conviction.

Obtaining an expungement

You can obtain an expungement after you have completed supervision, and waited for the obligatory statutory period of time to expire. When this occurs, we can file a petition with the State's Attorney, the clerk's office, the local arresting agency, and the State Police stating that we intend to expunge your arrest records. The police will have the opportunity to present any objections they may have to the court, and the court can grant or deny the petition. In the event the court denies your petition, you can appeal to a higher court.

If the court grants your petition, we will mail a copy to the arresting agency and they will send back the original fingerprint cards, photos, and arrest reports. Next, our lawyers will forward the order to the Illinois State police, who will then remove the arrest record from their database, such that if a background check is run on you, no arrest will show up.

Clemency

The only way to get a conviction off of your record is to petition for executive clemency. Our lawyers have experience in executive clemency and will petition the Governor's office through the Illinois Prison Review Board. Clemency does not erase the crime, rather it simply forgives it, so the conviction may no longer be used against you.
